What Happens When Your Driving Licence Expires?

Category 1: Renewal Within the 30-Day Grace Period

When your licence expires, the RTO gives you a 30-day grace period to get things sorted.

  • Penalty: None.
  • Driving Test: Not required.
  • Medical Certificate (Form 1A): Only required if you are over 40 years of age or driving a transport/commercial vehicle.
  • Process: Simple online renewal via Sarathi Parivahan. The renewed licence validity starts from the original expiry date, keeping your driving history continuous.

Category 2: Expired for 1 Month to 1 Year

If you miss the 30-day grace period, you can still renew your DL online, but with penalties.

  • Penalty (Late Fees): A late fee of ₹300 per year (or part thereof), plus ₹1,000 per year for the delay.
  • Driving Test: Not required.
  • Process: Normal renewal process, but you will pay significantly higher fees online during the application submission. Your new licence validity starts from the date of the new application.

Category 3: Expired for 1 Year to 5 Years

This is where things get strict. The RTO considers that you might have lost your driving proficiency if you haven't held a valid licence for over a year. अब ड्राइविंग टेस्ट दोबारा देना पड़ेगा!

  • Driving Test: Mandatory. You will have to book a test slot and physically demonstrate your driving skills again at the RTO track.
  • Medical Certificate: Mandatory for all applicants, regardless of age. You must upload Form 1A signed by a registered medical practitioner.
  • Penalty Fees: ₹1,000 for every year of delay + standard renewal fees + smart card fees + driving test fees. This can easily cross ₹3,000 to ₹5,000.
  • Steps: Apply online > Pay fees > Upload Form 1A > Book slot > Visit RTO for biometric and driving test > Receive DL by post.

Category 4: Expired for 5 Years to 10 Years

If your licence has been expired for 5+ years, automatic online renewal is often blocked by the Sarathi system.

  • RTO Permission: You must visit the RTO physically and submit a manual application to the RTO/ARTO (Assistant Regional Transport Officer).
  • Affidavit Needed: You must submit an affidavit on stamp paper explaining exactly why you did not renew the licence for over 5 years (e.g., you were living abroad, severe medical conditions, etc.). बिना वैध प्रमाण के आवेदन रद्द किया जा सकता है।
  • Approval is Discretionary: The RTO has the legal right to reject your renewal request if they find your reasoning unsatisfactory.

Category 5: Expired for More Than 10 Years

According to standard RTO practices across most Indian states, a driving licence expired for over 10 years is considered dead and permanently void.

  1. Apply for a new Learner's Licence (LL) via the Sarathi portal.
  2. Pass the computerized traffic signs and rules test online or at the RTO.
